First Habeas Corpus Now Your Miranda Rights

WASHINGTON (Reuters) – The U.S. Supreme Court ruled on Tuesday that police, under certain circumstances, can initiate an interrogation of a suspect without the defendant’s lawyer being present.

By a 5-4 vote, the conservative majority overruled a 23-year-old Supreme Court decision that barred the police from initiating questioning after a defendant asserted the right to an attorney at an arraignment or similar proceeding.

The 1986 decision held that once a defendant invoked the right to counsel, only the suspect, and not the police, can initiate the contact.

The ruling was the latest in a recent string by conservative justices expanding the power of police to question suspects, but it does not change the landmark 1966 ruling barring the police from questioning a suspect who invoked the right to remain silent or have a lawyer present.

Stop “Helping”

While much of the country?s attention is on other issues, a serious situation is developing in Pakistan that threatens to plunge us into another fruitless and bloody war. It is very frustrating to see that many who were so vehemently against the wars of the last administration have suddenly lost interest in foreign policy simply because we were promised change.

Those still paying attention know that nothing could be further from the truth. Very little has changed, except perhaps rhetoric, but what does that matter when the bombing missions are only getting deadlier? Rather than drawing down violent military interventions into the affairs of other countries, the new administration is escalating the foreign policy of the previous administration.

In Pakistan that entails the continuation and even escalation of military interventionism just across the border with Afghanistan. The targets are believed to be enclaves of Taliban militants, however, many innocent civilians have been caught in the deadly crossfire, severely damaging our image in the region. Many ordinary Afghanis and Pakistanis that never had cause to take up arms against us are being provided with motivation as family and friends are killed and maimed by our clumsy and indiscriminate bombs. Is it worth it for us to be involved in this way at such a high cost of blood, treasure and goodwill? Is there anything to be gained by this policy?

Mass. Senate approves pandemic flu prep bill

The Massachusetts Senate has unanimously passed a pandemic flu preparation bill that has languished in the Legislature before the recent swine flu outbreak.

The 36-0 vote today sends the measure to the House. Both branches have taken it up in past years, but have not been able to agree on the details.

The new Senate version would allow the public health commissioner ? in a public health emergency ? to close or evacuate buildings, enter private property for investigations, and quarantine individuals.

The measure also requires a registry for volunteers that would be activated in an emergency and establishes fines of up to $1,000 for not complying with local public health orders.

Sen. Richard Moore, chair of the Health Care Financing Committee, says the swine flu outbreak provides added impetus to pass the measure.
